MDP Group Inc SMS Terms & Conditions

By opting into or participating in any SMS program offered by MDP Group, you accept and agree to these SMS Terms & Conditions. Your agreement to these terms constitutes your express consent to receive SMS messages from MDP Group, in accordance with these terms and our Privacy Policy. If you do not agree with these terms, please do not opt-in to receive mobile text messages from MDP Group.

1. Program Description

MDP Group offers a person-to-person (P2P) SMS messaging program designed to facilitate direct communication between MDP Group employees and individuals, primarily for [briefly describe the types of conversations, e.g., service inquiries, project updates, scheduling, follow-ups related to your business activities]. These messages are not for marketing or promotional purposes unless explicitly consented to by the recipient for specific campaigns.

2. Message Frequency

Message frequency will vary depending on the nature of the conversation initiated by MDP Group employees. You will receive messages only when an MDP Group employee initiates a conversation with you or responds to your inquiries. This is primarily a two-way communication channel.

3. Opt-In

When an MDP Group employee initiates a person-to-person SMS conversation, an opt-in message will be sent to you. By responding as instructed (e.g., "START," "YES," "OPT IN"), you consent to receive SMS messages from MDP Group. Your consent to receive SMS messages is not required as a condition of purchasing any goods or services from MDP Group.

4. Opt-Out (STOP)

You can cancel the SMS service at any time. Simply reply "STOP" to any message you receive from MDP Group. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from MDP Group from that specific number or program. If you wish to rejoin, you may do so by initiating a new conversation or by following opt-in instructions if provided again.

5. Help (HELP)

If you are experiencing issues with the messaging program or need assistance, you can reply with the keyword "HELP" to any message. We will respond with instructions on how to use our service and how to unsubscribe. You can also contact us directly at:

6. Message and Data Rates

As always, standard message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

7. Supported Carriers

We are able to deliver messages to the following major mobile phone carriers in Canada: Bell Mobility, Rogers, TELUS, Freedom Mobile, Videotron, Fido, Koodo, Virgin Mobile, Chatr,  Public Mobile. Carriers are not liable for delayed or undelivered messages.

8. Your Mobile Phone Number

You represent that you are the account holder for the mobile phone number(s) that you provide to MDP Group. You are responsible for notifying MDP Group immediately if you change your mobile phone number. You may notify MDP Group of a number change by contacting us at support@mdpgroup.ca or +1-236-235-1120. You agree to indemnify MDP Group in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify MDP Group if you change your phone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Canadian Anti-Spam Legislation (CASL).

9. Privacy Policy

10. Disclaimer of Warranty

The service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including, but not limited to, warranties of performance, availability, quality of service, or fitness for a particular purpose. MDP Group does not warrant that the SMS service will be uninterrupted, error-free, accurate, or complete. You agree that all use of the service is at your sole risk.

11. Limitation of Liability

To the fullest extent permitted by law, MDP Group and its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the SMS service, even if advised of the possibility of such damages.

12. Changes to Terms and Conditions

MDP Group reserves the right, in its sole discretion, to modify or replace these SMS Terms & Conditions at any time. Any changes will be effective immediately upon posting the revised terms on our website. Your continued use of the SMS service after any such changes constitutes your acceptance of the new Terms & Conditions.

13. Governing Law

These SMS Terms & Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
